GUBCs are a favorite tool of the gun control crowd. They claim it’s about fighting crime, but there’s zero evidence that these laws actually reduce crime. In fact, as John Lott has pointed out, they almost always end up hurting innocent gun owners.
Erich Pratt, Senior Vice President of GOA, summed it up perfectly:
This decision vindicates the rights of all Virginians to engage in lawful private firearm transfers without unconstitutional barriers. The Act’s enforcement mechanism was fatally flawed from the start—criminalizing everyday citizens while ignoring basic constitutional principles. We’re grateful the court recognized that patchwork fixes can’t save a broken law.”
UBCs are already law in 20 states, and gun control advocates are working hard to push them into red states through federal legislation.
Congress is currently pushing H.R. 18, the so-called Bipartisan Background Checks Act. Despite the name, only one Republican, Rep. Brian Fitzpatrick of Pennsylvania, is backing it.
