H.R. 38 – Constitutional Concealed Carry Reciprocity Act

H.R. 38 has been introduced for the 119th Congress (2025 – 2026) as the National Concealed Carry Reciprocity Act.

Summary of Legislation:

H.R. 38 would create national concealed carry reciprocity, allowing law‑abiding Americans with a valid concealed carry permit (or who are eligible to carry without a permit in their home state) to carry a concealed firearm in any other state that allows concealed carry. The bill does not create a federal permitting system; it simply requires states to recognize each other’s permits the same way they recognize driver’s licenses.

The bill also includes protections for gun owners who accidentally enter a restricted area, requiring authorities to allow them to leave without arrest if they were otherwise law‑abiding.

Cleared the House Judiciary Committee and is waiting for a vote in the House. No vote has taken place as of July 8, 2026.
