A growing coalition of Second Amendment organizations is backing Darius Duvall, as the National Rifle Association has now filed an amicus brief in Duvall v. Maryland. The case centers on whether Maryland can criminalize a lawful gun owner who was carrying under a valid Washington, D.C. permit while traveling through the state.
Duvall was arrested in Maryland and turned into a felon solely for exercising his Second Amendment rights. Despite holding a legitimate D.C. carry permit, Maryland charged him under its “wear and carry” statute, and a judge sentenced him to three years in prison.
Duvall is not currently incarcerated, as his case is now on appeal. He has asked the Maryland Supreme Court to take up the case and review whether Maryland’s refusal to recognize out‑of‑state permits violates the Constitution, especially in light of Bruen.
One of the NRA’s primary arguments is that Maryland’s ban on recognizing out-of-state permits is out of line with the country’s historical traditions.
A long list of gun‑rights organizations filed amicus briefs before the NRA joined the fight. Those groups include: Second Amendment Foundation, Maryland Shall Issue, California Rifle & Pistol Association, Minnesota Gun Owners Caucus, Second Amendment Law Center, Cato Institute, and the Citizens Committee for the Right to Keep and Bear Arms.
